1.1 Use of this website provided by Southend Refills, (“Us”) by your business, officers and employees, (“You”) and any service contained within constitutes acceptance of these Terms & Conditions.

1.2 By accessing or using any part of the site, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

1.3 Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions. You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

2. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
2.1 We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information.

4. CUSTOMER USE

4.1 You should always check the contact information you provide is correct before creating a customer account or proceeding to payment.

4.2 Our website is only intended for use by adults, as defined as those aged 18 or over and who have sufficient capacity to enter into a binding agreement.

5. ACCOUNT INTEGRITY

5.1 As part of the checkout process you will need to create an account, including a username & password. It is your responsibility to ensure that the information you provide is accurate and not misleading. You cannot create an account or username & password using the names and information of another person or using words that are the trademarks or the property of another party or vulgar, obscene or in any other way inappropriate.

5.2 You are responsible for maintaining your own username and password via our website. You should ensure that you store your username and password securely and that the details required to access your customer account are not provided to another party.

5.3 You are responsible for your customer account and any actions taken within it. If you are aware or suspect that your customer account username and password or other details have become known to a third party, you should inform us immediately.

6. PRODUCTS AND SERVICES
6.1 We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

7. PRODUCT AND SERVICE PRICING

7.1 We make every effort to ensure that the pricing displayed on our website is correct. However, if an error in the pricing of a product or service is found we reserve the right to either cancel your order or contact you to arrange payment of any extra sum due or refund any overpayment made by you (as applicable).

7.2 We reserve the right to alter all product and service pricing without notice.

8. ACCURACY OF BILLING AND ACCOUNT INFORMATION
8.1 We reserve the right to refuse any order you place with us.

8.2 We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.

8.3 We reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

9. ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order, or purchased a subscription).

10. BOTTLE DEPOSIT

10.1 A deposit of £5 must be paid before a customer’s first order containing refill products.   This is to cover the cost of the containers that will be supplied on a refill basis.

10.2 Any loss or damage to the containers (including caps and lids) in your possession will be deducted from this deposit.

10.3 If you decide to no longer use the refill service, the deposit will be refunded subject to collection of all containers in their original condition.

11. YOUR ORDER

11.1 All deliveries are subject to a minimum order value of £10 (not including delivery charges). Orders placed which do not meet this minimum value will be cancelled and refunded.

11.2 Orders for click and collect are not subject to minimum order value.

11.3 Payment can be made using either debit/credit card, paypal or via BACS. Orders will not be processed until full payment is received.

11.4 By making payment for your order, you confirm that:

a. You have read the full terms and conditions, and understand and agree to the terms and conditions.

b. You have read the full ingredients list and product information for each product you have ordered.

c. You have read and understood the product safety and ALLERGEN INFORMATION.

12. SUBSCRIPTION

12.1 Your subscription constitutes an offer to us to buy Products by subscribing to a Service. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that your subscription has been accepted. The contract between us (Contract) will only be formed on receipt of this email and once payment has been taken.

12.2 The subscription plan to our Services consist of an initial charge and then followed by recurring period charges as agreed to by you. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.

12.3 Southend Refills may alter the prices of products within your subscription without further authorisation from you.

12.4 By subscribing to our Services you are agreeing to pay recurring periodic subscriptions for an indefinite time until cancelled by you, on the subscription terms set out in the original order placed. You can cancel your subscription at any time. You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you.

12.5 If you have more than one subscription active at the same time, Southend Refills may consolidate the products into fewer subscriptions without further authorisation from you.

13. SUBSCRIPTION CANCELLATION RIGHTS

13.1 If you wish to cancel your subscription with us, you must cancel 7 days before your next payment is due to be collected, in order to avoid receiving your next delivery. Customers cancelling after their payment has been taken will receive their next delivery.

13.2 We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

14. DELIVERY

14.1 Your order will be delivered on the specified date for your postcode area, unless there are exceptional circumstances. Southend Refills will aim to notify you in reasonable time if there will be a delay in your order being delivered. Your order will arrive any time between 0600 and 2000 on your delivery day and we are unable to provide a specific time period within that. Southend Refills cannot accept responsibility for any delays in delivery that are out of our control.

14.2 Deliveries are made to the address provided during checkout, unless written notification to change this delivery address is provided by you. Southend Refills cannot accept responsibility for deliveries that do not reach the customer due to an incorrect delivery address being provided.

14.3 Deliveries will be made to a specified “Safe Space” on your property. The “Safe Space” must be specified at checkout. The products will be at your risk from the time of delivery to your “Safe Space”.

15. COLLECTION

15.1 When containers are left out for collection please ensure they have been thoroughly rinsed and dried.  Lids and caps must be present, any missing caps and lids will result in a charge taken from the container deposit. 

16. PRODUCT SAFETY INFORMATION

16.1 Southend Refills are not the product manufacturers of any product supplied.
16.2 Southend Refills provide ingredients and usage instructions, including hazard warnings, on labels on all of our supplied products. This information can also be found on the product information pages on www.southendrefills.co.uk. Detailed product information can be found on the websites of the product manufacturers, Southend Refills can direct you to this information if required.
16.3 All of the products supplied by Southend Refills are sourced from reputable suppliers and comply with all relevant product testing/safety legislation.
16.4 Supplied products must only be used for their intended purposes and in accordance to manufacturer’s guidelines.

17. SUPPLY AND DECANTING OF REFILL PRODUCTS

17.1 Products sold by Southend Refills on a return and refill basis will be supplied to the customer in glass or aluminium bottles/jars that must not be used to store the product.
17.2 Product should be decanted into appropriate containers with correctly fitting caps as soon as possible.
17.3 Ensure to follow safety precautions while decanting, including wearing gloves/eye protection where indicated, and not decanting in the presence of children or animals. Deal with any spillages immediately.
17.4 Ensure all containers are clean and dry before use.
17.5 Ensure any container is correctly labelled, including hazard/safety warnings where appropriate.
17.6 Products supplied with child safety caps, should be decanted into an appropriately secure container.
17.7DO NOT decant any products into food/beverage containers to avoid accidental ingestion.
17.8DO NOT decant any product into bottles which previously contained bleach or any other chlorine containing products.
17.9 The customer is responsible for keeping containers out of reach of children.
17.10If the customer does not to decant the product into their own container before use, Southend Refills are not responsible for any mishandling or accidents.

18 BROKEN OR LEAKING CONTAINERS

18.1 All bottles, jars, lids and caps are checked for possible damage on collection, before and after cleaning, before and after refilling and upon delivery and are immediately removed from circulation if any damage is noted.
18.2 The caps/lids of all bottles and jars are checked before being left on doorsteps or handed to the customer, Southend Refills is not responsible for any leakage, or damaged caused by product leakage, after bottles have been delivered or handed to the customer.
18.3 If any damage occurs while the bottle/jar is in the customer’s possession, the customer is responsible for the safe disposal of the damaged item.

19. ALLERGEN INFORMATION

19.1 DUE TO THE UNPACKAGED NATURE OF OUR PRODUCTS WE CANNOT GUARANTEE THAT CROSS CONTAMINATION FROM OTHER ALLERGENS DOES NOT OCCUR.

THEREFORE WE RECOMMEND THAT OUR PRODUCTS ARE NOT SUITABLE FOR THOSE WITH ALLERGIES OR SENSITIVITIES.

19.2 YOU WILL BE SUPPLIED WITH LABELS INCLUDING INGREDIENTS AND DIRECTIONS FOR USE. PLEASE READ BEFORE USE AND ENSURE THAT THESE ARE KEPT VISIBLE AT ALL TIMES.

19.3 Ingredients and allergen information is available for each product before purchase and should be read thoroughly.
19.4Upon delivery, all products are labelled with full ingredients lists, with common potential allergens highlighted.
19.5Products and containers are stored, packaged and transported in an environment which is NOT ALLERGEN FREE.
19.6 The customer and each person using the product is responsible for testing each product prior to use to reduce the risk of allergic reaction.
19.7 Southend Refills cannot accept any responsibility if the customer, or anyone using the products, has an allergic reaction when using the products.

20. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

20.1 We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

20.2 You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

20.3 You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

20.4 In no case shall Southend Refills, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility.

21. OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

21.1 We have the right to revise and amend these terms and conditions from time to time to reflect changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our system’s capabilities.

21.2 You will be subject to the policies and terms and conditions in force at the time that you place and order with us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority.

22. LAW AND JURISDICTION

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
